I came back on Sunday after landing with a expired visa but valid H1B till 2010

So we donot need a valid stamped visa to come back. ? We can come back if we have H1 papers.Thanks for the respose.

I140 porting is based on an approved I140 from a previous labor and hence is different from labor substitution. Therefore theoretically that labor was not allowed to expire even after the rule comes in to effect. Having said that I would rather pose this question to a lawyer.

Hi All,
I have been following the postings on this forum. I appreciate all the hard work the core group is doing. I also appreciate the active participation by all members in answering/discussing the forum topics.
I have contributed a one time $200.00 in support and would contribute more and request every one to support in there capacity.
Every one needs PR status, but in my case, the need is more for my wife, because of the reason that she wants to pursue her medical residency here.
I sometimes wonder and sometimes I feel like going back to India, work for my present company for 1 year, come back here on a managerial/executive position on L1 along with my wife and apply for Perm in Eb1 cat...this said is all my thought!
This would enable my wife to get work permit as L1 dependent and an eventually a residency position in a good univ and a current 1-485 status.
Only thing though is my wife would need to attend interviews.
Any suggestions/feedback will help me and all other people in this situation.

It's going to get worse from here, atleast the good thing is people who are "breaking" the laws or working through loopholes will sober up and it might turn out to be a goodthing
as long as existing rules are followed it should be ok, the problem will arise if the protectionists come up with absurd compliances, hopefully there will be a balancing act that follows and works out for the better of the system.

In that case, your divorce should not affect your I-485. You only need to make sure that you (or your lawyer) withdraw the I-485/EAD/AP for your wife.

Here is my situation
Studied in US on F1 and directly started working for company A from 2002. Got a H1 stamp when out of country in 2003.
Since then moved to company B (in 2005) and H1 visa is now on the second three year term (valid till 2008) . Am on the verge of moving to company C. Will be out of the country all of april and had a few questions
1) Do I need to have stamp on my passport when I switch between F1 and H1only or do I need the stamp even if I have switched firms since the last time I got my passport stamped
2) What happens if I get the stamp say on H1 on 1st April (while on payroll of company B), quit company B (while outside US) and join company C and then return to US in last week of April without getting another stamp. Will I face any issues when reentering USA (given that the stamp is for company B even though I don't work for it anymore) or do I need the accurate stamp when coming to USA?
Your help will be deeply appreciated

I too have the same issue of not getting any RN nor the checks are cashed. Its been a month now. Today I called USCIS and they told me to wait for another month since no one has touched the application yet.

I had a somewhat similar issue where my parent's I-94s had wrong names on them (Both had same names printed on them). My colleague at work told me that he got name spelling fixed for her mom by going back to the same airport. First I did not believe him, but when I tried it worked. By the way in my case I went back after 2 weeks and POE was IAD.
It looks like you can get minor errors on your I-94 fixed at the POE itself.

I filed back in June, 07. I got second FP notice for my wife. Nothing for me so far and I am primary applicant.
Same for me. I even opened a SR. Got a reply saying FP on file. No need for another one.

Is it the employer's responsibility to consider in which Green Card Category the employee will fall in future before puts ad.?
Bachelor degree would be enough to do the job if EB3 has a PD around 2005/2006/Current.
Just because the PD is before 2005, doesn't mean the job needs masters degree. The job responsibilities will remain the same. The person doing the job would have acquired the necessary experience to carry out a job that falls in EB2.
Also, not everybody qualified for EB2 may be able to find a job that is in EB2. That's a different story .

To Administrator: Why are you deleting my post. I am just copy pasting a PURE TRUTH i.e. a TEXT OF LEGISLATION. I am not making up things. There are many other threads where people are just discussing unnecessary stuff. I am just saying that legal immigrants who have not yet applied for EB should contact congress to include us in any kind of amnesty - not exclude us. How does this view go against anybody in this forum?? Infact it will benefit everybody. A "blanket" amnesty will give everybdy a GC including those who have and those who havent applied for EB yet.
I am not saying the 2009 or 2010 CIR would definitely exclude legals in US from amnesty but we should contact congress and white house that it should not happen like the it was almost going to happen in 2006.

You need not be here in US until the GC is approved. There is no abandoning if he has valid offer and some way of re-entry like valid AP or H1.

Hi, I wouldn't bank on what officer says as it is not binding. You need valid AP to enter US and there should be no confusion about it.
You should take Employment verification letter and latest stubs although it is not 'required'. I believe your July 20th paystub should be sufficient but if you have access to your latest electronic paystubs(ADP website) it is not a bad idea to print them out. Otherwise don 't bother.
