i have read some place in this forum that as long as you maintain your full time primary job you are entitled to use your ead for other smaller assignments without losing your H1 status. But then again I am not a lawyer just sharing what I have read.
AFAIK, Using EAD either for a FT or PT job should invalidate other non-immigrant work authorization documents like H1B since EAD is a derivative benefit of filing for immigrant status and you cannot mix and match your status...
If this is not true and there is a discussion on this forum clarifying that, I would like to know too...

They might accept the application but send in an RFE with a request to pay the difference ;)
Wish USCIS accepts applications after 27th and ask for the fee difference .. Win Win for all if the fee was the concern for USCIS .. hehe:D :D

Hi Sir,
I have a question regarding H1B transfer and should I go premium processing or not?
Here is my case:
I was laid of from Company A (not consulting) last week. I have all my past pay stubs. That was total shock to me and got me off-guard.. It took me few days to find a consulting company B which is willing to transfer my H1B.
As any big company, A is quite prompt in sending revoke letter so I would assume they would be already doing it by now. Company B will be sending transfer papers tomorrow(Friday) or Monday.
My question is should I go with Premium Processing or not? I just dont want to take any risk where USCIS denies my case. Is premium processing going to help me here or not.

She definitely would have issues if plan to travel in TN visa. TN visa is not supposed to have any immigration intent.
The best thing to do is change her status to parolee and start working using EAD. There is no reason for her to continue in TN status, after filing 485.

I agree w/ Morch: TN, unlike H1B, is not a dual-intent visa. Change to EAD/AP.

when you are applying for I140 - You may get RFE due to the fact that your education is not matching (equivalent to) 4 years. So it is better to show the education as 4 years ie..if you have some other degrees/diplomas along with your 3 years degree. this has to be mentioned in box#15.

WRONG!!! What date did Fed Ex (or any carrier) leave ur pkg at the Service Center? That's when ur 6-month countdown begins.

I am in same boat.. I am going mumbai india in feb for stamping. Where are you going for stamping. I heard lately that there is no way we can pre check PIMS. I have asked my lawer but haven't got reply yet.. If you lawer has sent duplicate copy of H1b document to Kentucky Visa center then there should not be issue.( 99.99 % should be safe ).. If not then there is risk involved.
Do you know how a lawyer can send the duplicate copy to Kentucky visa center, my h1 got approved 3-4 weeks ago, can we still send the duplicate copy to kentucky visa center ??? Did you do that ??

Ok. That makes sense. I will contact the HQ and try to find out the solution. Calling the local SS office doesn't help as the first thing their automated system asks for is SS# for you to move on!

A couple of points : 485 is your property. Its a grey area whether to inform USCIS or not, some advocate it as its a proof and file AC21 and some have different opinion its a personal choice. Regarding using AP I myself dont see an issue. Rest of all are supporting dox. Nice to have supporting documents.

I will file for my 485 this week. Next week I leave for India for 2 weeks. With the frontlog I wont get my 485 receipt this week. I have valid H1B. When I enter without 485 receipt will that be a problem? Will my 485 be abandoned in case there is problem? Please advice. Thanks.

Minimum requirement for Sr. Software Engineer can be MS + 2 years experience.
